Survey Update
Well, darn glad I did that cause there is no way I would have been able to identify this path – it was never cleared. Apparently it was some hollow writing to make the sale viable early on, no intention of being fulfilled.
Oh also, yes that’s a huge ditch in front of the ‘access road’
However in consulting New York property law I found that non-property owners have right to ‘clear and maintain access’ within their granted right of way. So with lots of pink ribbon as my guide it’s time to start clearing!(interesting note I got in informal consultation is that although I can clear access I cannot just clear the materials, i.e. trees, because they are still the rightful property of land owner, so they will get piled to the owners lot for their handling.)
Also means I need to get working with the town on a culvert to span the ditch.
(if you’re feeling upset as a landowner yourself, I get it. I was surprised by the rights outlined in NY law myself. But keep in mind in this case the land is owned by a fruit company CEO in another state who inherited from his brother and never set foot there)
